We’re pretty sure it’s possible, but nothing beats confirmation especially if it’s coming from the experts. The iPhone Dev Team has confirmed that the new iPhone 3.0 firmware can indeed be jailbroken though when exactly an appropriate iPhone 3.0 jailbreak will be released wasn’t mentioned. They do, however, warn YellowSnow users who have access to this new firmware to stay away from it for the time being as it will remove the iPhone 3G unlock with no way of reverting back to the old baseband. Anyway, with so much time on their hands, the iPhone Dev Team will probably be able to release the iPhone 3.0 jailbreak just in time for the public distribution of iPhone 3.0 firmware similar to what they did back with the iPhone 2.2 jailbreak. Hopefully by then, iPhone jailbreaking will also be deemed legal as well.

Jailbreak is legal, if you do not share the “custom ipsw”.
The court has upheld, apparently, it is okay if you “jailbreak” in your own computer.
The ipsw has to be from Apple, and not distributed by anyone else.
It would be good if Apple would allow approved developers to do more.
That seems to be being allowed, in 3.0 and I do hope we will see more approved.
